Terms and Conditions
Returns
According to the EU Distance Selling Directive, the consumer is protected by a number of safeguards and entitlements. AS-Trim is commited to complying with this directive. With this in mind you are entitled to a seven-day 'cooling-off period', whereby you are entitled to return your purchase to us for any reason within seven days of receipt of same, and be refunded the price that you paid, minus the delivery charge (Delivery charges will be calculated per order in the case of free delivery options). This safeguard applies only where the products in question are unopened, unused, undamaged, and returned to us in full saleable condition. Charges for returning the product(s) must be borne by the purchaser.
Refunds
Refunds will be issued in the same form as the original payment. If paid for by credit card, a credit will be made to the original credit card number provided on that specific order. If product(s) purchased from AS-Trim should be returned for whatever reason, the customer shall return the product(s) to us under the following terms.
Returns to AS Trim
Customer must request a returns/exchange form by contacting us by either phone or email. The returns form must be requested within 14 days of receipt of goods.
Before a refund and /or reshipment can be issued, the product in question must be returned to AS-Trim along with a completed return form. AS-Trim will not be responsible for damaged parts if customer does not follow this process. Please retain delivery information including tracking numbers, until you have been credited by AS-Trim or a replacement product is received. AS-Trim cannot be held liable for any lost packages that are not given any type of tracking number or relevant documentation. If AS-Trim determines that failure of the product(s) was not a result of a defect in materials or packaging, or if the reason for return does not involve a fault with the product, then AS-Trim reserve the right to charge the customer a 35% restocking fee. AS-Trim will advise customer prior to assessing these charges.
If a completed returns form is not included, there will be a delay in the returns process. If you do not state whether you desire a refund or replacement, a standard replacement will be issued.
Taxes
All products offered for sale on this site are inclusive of VAT at 20%
Payment
We do not store credit card details nor do we share financial details with any 3rd parties.
Unless payment is made via our secure online payment system, or otherwise stated, all payments shall be due upon receipt of an invoice. AS-Trim reserves the right to obtain a security interest in all products sold to the customer, and in proceeds thereof, until the customer makes full payment. A £20 collection fee will be charged for any and all dishonoured cheques.
Prices
AS-Trim reserves the rights to change the prices for any or all of its products without prior notification. Please note VAT inclusive prices are prominently displayed beside each products title and picture for clarity.
Delivery
AS-Trim is based in Ipswich, Suffolk, where we have a large warehouse and office with on site storage for larger and volatile products. We hold a very large stock of all items on our website and only advertise what we keep in stock. We may occasionally show products on the website that are not typicaly kept in stock but these are offered on a telephone sales basis only. Special order or out of stock items may require a 20% deposit deductable from the total order value (minus delivery).
We use Fedex and Royal Mail for all our parcels who both provide a fully traceable next day or economy delivery service and were chosen for the care and attention with parcel handling and their excellent history of efficiency and reliability.
Risk of Loss
AS-Trim liability for delivery shall cease, and title and all risk of loss or damage to the products as a result of misuse, or damage to personal property as a result of misuse shall pass on to the customer.
Undelivered Products
A 15 business day waiting period is required before any product shall be resent or any order be cancelled at the discretion of AS-Trim, per customer request.
Limitations
AS-TRIM MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, AND AS-TRIM DISCLAIMS AND NEGATES ALL OTHER WARRANTIES, INCLUDING WITHOUT LIMITATION, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, CONFORMITY TO MODELS OR SAMPLES, OR ANY WARRANTIES OR INDEMNITIES AGAINST INTELLECTUAL PROPERTY INFRINGEMENT. IN NO EVENT SHALL AS-TRIM BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES. ALL DISPUTES ARISING OUT OF OR RELATED TO THE LIMITED WARRANTIES SET FORTH HEREIN (CUSTOMER DISPUTES) SHALL BE GOVERNED BY THE LAWS OF THE UNITED KINGDOM. CLAIMS AGAINST AS TRIM FOR SHORTAGES SHALL BE DEEMED WAIVED IF NOT MADE WITHIN (3) BUSINESS DAYS AFTER RECEIPT OF SHIPMENT.
Entire Agreement
These terms and conditions, including those on the face hereof, constitute the entire agreement with regard to this sale and expressly supersede and replace any prior or contemporaneous agreements, whether written or oral, relating to said sale, including any terms and conditions on any customers documents or purchase orders. This agreement shall be binding upon the heirs, successors and assigns of the parties here to. If any provision of this agreement shall be held to be invalid or unenforceable, the remainder of this agreement shall remain in full force and effect.
Governing Law, Jurisdiction and Costs
This agreement is governed by the laws of the UNITED KINGDOM, without regard to its conflict or choice of law provisions. Customer acknowledges and agrees that the UNITED KINGDOM is an appropriate place for venue of any litigation and that UNITED KINGDOM courts have jurisdiction over this agreement and customer. In the event the customer and AS-Trim are unable to resolve any customer dispute, and any collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover its costs and reasonable legal fees incurred.
Terms and Conditions
This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control. ANY ADDITIONAL, DIFFERENT OR CONFLICTING TERMS AND CONDITIONS ON ANY SUCH DOCUMENT ISSUED BY CUSTOMER AT ANY TIME ARE HEREBY OBJECTED TO BY AS TRIM, AND ANY SUCH DOCUMENT SHALL BE WHOLLY INAPPLICABLE TO ANY SALE MADE HEREUNDER AND SHALL NOT BE BINDING IN ANY WAY ON AS TRIM..
